4. User Responsibilities and Compliance

You acknowledge and agree that:

• You are solely responsible for ensuring your website complies with all applicable laws and regulations, including but not limited to GDPR, ePrivacy Directive, and other data protection laws.
• Our Service provides technical indicators only. We make no representations or warranties about the legal compliance of your website based on scan results.
• A "PASS" result does not guarantee legal compliance. A "FAIL" result does not constitute proof of legal violation.
• You must independently verify all findings and seek appropriate legal counsel before taking any action.
• You may only scan websites you own or have explicit authorization to scan.

5. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Accuracy, completeness, or reliability of scan results
• That the Service will be uninterrupted, timely, secure, or error-free
• That defects will be corrected
• That the Service or the servers are free of viruses or harmful components

We do not warrant that scan results will detect all compliance issues or that following recommendations will ensure legal compliance.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Any regulatory fines, penalties, or legal actions resulting from your website's non-compliance
• Damages arising from reliance on scan results or recommendations
• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Service interruptions, errors, or inaccuracies in results

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE PRECEDING 12 MONTHS, OR €100, WHICHEVER IS LESS.

Some jurisdictions do not allow limitation of liability for consequential damages, so this limitation may not apply to you.

7. Indemnification

You agree to indemnify, defend, and hold harmless Cookie Compliance Scanner, its operators, affiliates, and service providers from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Scanning websites without proper authorization

8. PDF Reports and Digital Products

PDF reports are digital products delivered electronically. Once delivered, they cannot be returned.

Refund Policy: Due to the immediate delivery of digital products, all sales are final. Refunds may be issued at our sole discretion only in cases of technical errors preventing delivery.

PDF reports are generated based on the scan performed at the time of purchase. Website configurations may change after the scan. We are not responsible for implementing recommendations or ensuring their effectiveness.

9. Service Availability and Modifications

We reserve the right to:

• Modify, suspend, or discontinue the Service at any time without notice
• Change pricing, features, or scanning capabilities
• Limit the number of scans per user
• Refuse service to anyone for any reason
• Update detection rules and algorithms without notice

10. Prohibited Uses

You may not:

• Scan websites you do not own or have authorization to scan
• Use the Service to harm, harass, or threaten others
• Attempt to reverse engineer, decompile, or extract the Service's logic
• Use automated systems to excessively scan or burden the Service
• Resell, redistribute, or commercially exploit scan results without permission
• Misrepresent scan results or our relationship with you

11. Intellectual Property

The Service, including all content, features, scanning algorithms, and functionality, is owned by Cookie Compliance Scanner and protected by copyright, trademark, and other intellectual property laws.

Scan results and PDF reports generated for your website may be used by you for internal purposes. You may not claim ownership of the Service's underlying technology or methodologies.

12. Third-Party Services

The Service may use third-party tools and services for scanning, data storage, and analytics. We are not responsible for the performance, availability, or policies of third-party services.

13. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to conflict of law principles.

Any disputes arising from these Terms or use of the Service shall be resolved through binding arbitration in accordance with Spanish law, except where prohibited by applicable consumer protection laws.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
